Welcome to Powered by Women.

These terms govern your use of the Powered by Women app (“the app”), which is operated by Powered by Women (“we”, “us”). Powered by Women is a professional community where women in business connect, support one another, and grow. These terms form the agreement between you and us, and they exist to keep that community trusted, fair, and safe for everyone in it.

By creating an account or using the app, you agree to these terms and to our Privacy Policy. If you do not agree to them, you should not use the app. If you have any questions, you may contact us at hello@poweredbywomen.com.

1.  Eligibility and your account

Membership is open to any woman in business. You must be at least 18 years old and able to enter into a binding contract.

When you create an account, you agree to provide accurate and complete information and to keep it up to date. You may hold only one account, and you may not share it or allow anyone else to use it.

You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. If you believe your account has been accessed or used without your permission, please notify us promptly at hello@poweredbywomen.com.

2.  Membership and payment

Some features require a paid membership. You can subscribe in two ways:

We show the price and billing period before you buy. However you subscribe, your membership gives you the same access in the app.

The app may also sell tickets to real-world events. Stripe processes those ticket payments. Before you buy, the event listing and checkout will show the event, price, any applicable fees, and the cancellation and refund terms.

Deleting your Powered by Women account does not automatically cancel a subscription. You must cancel it where you bought it.

3.  How you may use it

Powered by Women is a community for networking. It exists so that members can find one another, support one another, and do business together, and you agree to use the app for those purposes.

To keep the community safe and welcoming for everyone, you agree not to:

These rules apply to profiles, posts, comments, questions and answers, direct and group messages, photos, files, links, and every other part of the app, including private areas.

Reporting and blocking

If you see content or conduct that may break these rules, use the Report action next to the content, message, or member profile. You may also contact us at hello@poweredbywomen.com. We review reports and respond according to the seriousness and urgency of the concern.

You can use the Block action to prevent an abusive member from contacting or interacting with you. A blocked member may not use another account to avoid the block.

Reports help us identify content and conduct that may break these rules. We may reject, remove, or limit content; restrict access to a feature; warn a member; or suspend or close an account that breaks these rules. We may preserve relevant evidence and contact an appropriate authority where the law requires it or where necessary to protect someone from harm. Where it is reasonable and safe to do so, we will tell you why we acted.

Do not use the app for an emergency. If someone is in immediate danger, contact local emergency services.

4.  What you post

You keep ownership of what you post. You give us a licence to host, store, reproduce, and display it for the purpose of running the service — for example, showing your profile to other members, delivering your message to its recipient, or reviewing reported content. That licence ends when you delete the content or your account, except for a limited copy we must keep for a legal, safety, fraud-prevention, payment, or dispute purpose. Other members may retain independent copies they made while they were allowed to see the content.

You confirm you have the right to post what you post, including any photo you upload.

5.  Other members

Powered by Women is built on trust and mutual support among its members. At the same time, we do not vet members — people sign up directly — and we do not verify what members say about themselves, their businesses, or their qualifications. Introductions, referrals, and connections made through the app are between the members involved.

Any business you conduct with another member is solely between you and that member. We are not a party to it and are not responsible for it. We encourage you to exercise the same judgement you would with any professional introduction.

6.  Availability

We work hard to keep the app running smoothly for you, though we cannot promise it will always be uninterrupted, error-free, or secure. We may add, change, or remove features as the community grows. When a change is significant and we are able to give notice, we will.

7.  Ending your membership

You are free to leave at any time. You may stop using the app and delete your account in Settings. Deleting your account removes your account and associated data, including user-generated content, except for information we must keep for a legal, safety, fraud-prevention, payment, or dispute purpose, as described in the Privacy Policy.

If you have a paid membership, please cancel it where you bought it — in your Apple or Google account for in-app subscriptions, or in your account on our website for web subscriptions. Account deletion does not automatically cancel a subscription. The app will explain how to cancel an active subscription before you confirm deletion, without preventing you from deleting the account immediately.

We may suspend or close your account if you break these terms, if we are required to by law, or if we stop offering the service. Sections 4, 5, 8, 9, 10, 11, 12, and 13 survive.

8.  The app itself

The app, and everything in it that is not yours — the name, the logo, the design, the graphics, the text we wrote, and the software — belongs to us or to our licensors. You may not copy it, distribute it, build on it, take it apart, decompile it, or extract its source code, and you may not use our name or logo without our written permission.

We grant you a personal, non-transferable licence to use the app for its intended purpose. On Apple devices, this licence is limited to Apple-branded products that you own or control and is subject to the Usage Rules set out in the Apple Media Services Terms and Conditions, and it extends to accounts linked to you through Family Sharing or volume purchasing. In the event of any conflict between these terms and those Usage Rules, the Usage Rules govern with respect to your use of the app on Apple devices.

9.  Apple's role

This section applies to the iPhone and iPad versions of the app. Apple requires it, and it exists to make one thing clear: your agreement is with us, not with Apple.

Apple is not a party

These terms are between you and Powered by Women only. Apple Inc. is not a party to them. We, not Apple, are solely responsible for the app and its content.

Maintenance and support

We are solely responsible for maintaining and supporting the app, to the extent these terms or the law require it. Apple has no obligation to provide any maintenance or support for the app.

Warranty and refunds

If the app fails to conform to a warranty that applies to it, you may tell Apple, and Apple will refund what you paid for the app, if anything. To the maximum extent the law allows, Apple has no other warranty obligation for the app, and any other claim arising from a failure to conform to a warranty is ours to answer for, not Apple's.

Claims about the app

We, not Apple, are responsible for addressing any claim you or a third party makes about the app or your use of it — including product liability claims, a claim that the app does not meet a legal or regulatory requirement, and claims under consumer protection or privacy law.

Intellectual property claims

If a third party claims that the app, or your use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.

Apple may enforce these terms

Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple gains the right to enforce them against you as a third-party beneficiary.

10.  Our responsibility

The app is provided “as is” and “as available.” We do not warrant that it will be uninterrupted, error-free, or secure, and we do not guarantee the accuracy of anything a member posts, says about themselves, or claims about their business. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or relating to your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

11.  Your indemnity to us

You agree to indemnify and hold harmless Powered by Women and its officers, employees, and agents from any claim, loss, damage, or reasonable cost, including legal fees, that arises from what you post or send through the app, from your use of the app, or from your breach of these terms.

12.  Compliance and other agreements

You confirm that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties. Apple requires this representation for apps distributed through the App Store.

You must also keep to any third-party agreements that apply when you use the app — your mobile data plan, for example. Data charges are yours.

13.  Governing law and disputes

These terms are governed by the laws of the State of California, and by applicable United States federal law, without regard to conflict-of-law principles.

If something goes wrong, we would rather hear from you and put it right. Please write to us first at hello@poweredbywomen.com, as most concerns can be resolved quickly that way.

If we cannot resolve a dispute informally, you and we agree it will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring a qualifying claim in small-claims court. The arbitration will take place in California, or by video or phone where allowed. Disputes are handled individually: you and we waive any right to a class action or class-wide arbitration. If the class-action waiver is found unenforceable, this arbitration agreement does not apply.

14.  Changes to these terms

We may update these terms. If a change materially affects your rights, we will tell you in the app or by email before it takes effect. Continuing to use the app after that means you accept the new terms.
